Constitutional Interpretation

While I often think that people tend to err when they try to develop a theory of Jewish law based upon American law, there is often much about American legal theory which can inform the debate about a legal theory of Jewish law.  There is a very interesting post by Lawrence B. Solum at his Legal Theory Blog on Originalism and constitutional interpretation.  Without much background in constitutional interpretation I thought that I wasn’t able to understand all of it, but I think that it is well worth the read for those interested in such topics.  Thanks to Balkan and Concurring Opinions for pointing out this post.
