Lecture: Gezerat Ha-Katuv in the Thought of Maimonides

Yair Lorberbaum (Professor of Law, Bar-Ilan University Law Faculty), this year’s Ivan Meyer Visiting Scholar in Comparative Jewish Law, will deliver a lecture on “The Concept of the ‘Decree of Scripture’ in the Thought of Maimonides.”
The term Gezerat Ha-Katuv is understood among halakhists and scholars as designating a halakhah that lacks a rationale. The lecture will analyze the radical meaning of this sense of the term, and show that it had a different meaning in the halakhic discourse of the talmudic literature and in Maimonides’ writings, where it designated a certain conception of legal formalism or rulism.
